Buying a Property

Once you have found your dream home and had your offer accepted by the sellers you should instruct your  conveyancing solicitor straight away. If you need a mortgage to buy the property then obtaining that mortgage should be your priority – otherwise you risk delay at a later stage. Once you have instructed your solicitor they will obtain the Estate Agent’s Memorandum of Sale giving details of the sale and obtain a Seller’s Package ( including the draft Contract, details of the title and information about the property). At that stage, your  conveyancing solicitor will make a local search – which deals with issues like planning permission and whether your property is in a conservation area etc.

Selling a Property

The first thing you need to do is find a buyer. Don't  forget if you use an Estate Agent to consider how commission will be paid. We can advise you on whether sole agency, multiple agency or joint sole agency is right  for you.

Letting a Property

Whether you are letting your house or flat as an investment or as a  result of working away, you will want to make sure your property is properly protected. We can advise on and draft agreements to deal with problems which can arise such as non-payment of rent, damage to your property or tenants refusing to leave at the end of a tenancy  Should disputes arise, we also have a strong litigation team as well as a debt collection team to help you.

Re-mortgaging

Timing is often very important when you re-mortgage . You need the work to be done as swiftly as possible.  Our conveyancing solicitors can act for both you and your lender to avoid doubling up work as well as dealing with the discharge of your existing mortgage. We can carry out the necessary enquiries and searches on your home even before you get the new mortgage offer. You should be aware that the enquiries necessary on a re-mortgage are as extensive as those on buying a property in the first place. Be aware  your new lender may require an up to date valuation of your home – instructing Surveyors approved by your new lenders is usually the most practical way to get a re-mortgage valuation.

Transfers of Equity

When a partnership or marriage comes to an end, often one owner buys the other's share. The value of this share is the difference between the outstanding mortgage and the current value of your home and is known as equity. It is essential that the transfer is recognised in Law to ensure  the owner selling their share is released from any commitment or mortgage payments on the property.
