Sometimes more formally known as a conditional fee arrangement or CFA, a no win no fee agreement does just what the name suggests.

If you win a case, the other side pays most if not all of your basic legal costs and other costs incurred by your solicitor such as court costs and costs of getting medical reports.

When you win a case using a no win no fee agreement, both your solicitor’s fees and their costs (known as disbursements) are usually paid by the losing side. Any costs which can’t be recovered from the losing side are normally covered by a special insurance policy. If on the other hand your solicitor loses the case, then he or she doesn’t get paid.

Your solicitor is taking a risk about winning your case when taking it on under a no win no fee arrangement. Why? Because under a No Win No Fee Agreement, if you lose your case through no fault of your own, your solicitor will not be paid, and that’s why they will usually receive what is known as “a success fee” on top of basic fees  (at rates set by the County Court) if your compensation claim is successful. The success fee is an additional fee for taking the risk on not being paid at all.
