What does no win no fee mean?
This sort of agreement is also sometimes called Conditional Fee (or CFA for short) and works as you might imagine. Conditional Fee Arrangements introduced as a way of helping those people who could not afford to pay legal fees upfront to bring a claim for compensation to court.
N.B. Legal aid is no longer available for personal injury claims and is only available for medical negligence claims in limited certain circumstances involving birth injuries
If your claim is successful, then the other side has to pay the majority of your legal fees and associated costs such as medical reports and court fees.
The only proviso is that the person making the claim must have suffered some sort of financial loss or injury through an event which was not their fault, but someone else’s.
If your compensation case taken under no win no fee is successful, then the losing side has to pay your solicitor’s costs and other fees (disbursements) like court fees or medical reports. Any costs which can’t be recovered from the other side are usually covered by insurance. Alternatively if your claim is unsuccessful, the solicitor won’t get paid.
Medical Negligence Claims in Wiltshire – Specialist Handling Required
We regularly help Wiltshire clients With medical negligence claim on a no win no fee basis. But these type of compensation claims are often particularly complex and require a different approach to standard accident claims. They frequently involve:
- Detailed review of medical records
- Independent expert evidence from appropriately qualified clinicians
- Careful analysis of causation (whether the breach of duty actually caused the harm)
Because of this complexity, not all firms are equipped to handle clinical negligence cases properly. Our Wiltshire medical negligence work is undertaken by solicitors with specific experience in this area, supported by trusted medical experts and, where appropriate, specialist barristers.

Is a No Win No Fee Claim Right for My Case?
Conditional Fee Arrangements (CFA), to give no win no fee agreements their proper name, came into existence as a way of helping those people who could not afford to pay legal fees upfront to bring a claim for compensation to court.
During your free initial consultation, our solicitors will assess whether a no win no fee arrangement is appropriate for you. This assessment typically considers:
- Whether another party can be shown to be legally at fault
- The strength of the medical and factual evidence
- The nature and severity of the injury or harm suffered
Whether you have sustained financial losses (such as lost earnings, care costs, or future treatment needs)
We will always be honest if we believe a claim is unlikely to succeed or would not be proportionate to pursue.
Why Choosing the Right No Win No Fee Solicitor Matters
No win no fee arrangements are widely advertised, but the quality of representation varies significantly. Choosing an experienced Wiltshire compensation solicitor can make a substantial difference to:
- The level of compensation recovered
- The time it takes to resolve the claim
- How stressful the process feels for you
Our focus is on careful case selection, thorough preparation, and calm, professional handling from start to finish.
How can I tell that my solicitor is a genuine compensation claim specialist?
With just over 140,000 solicitors currently practising in England and Wales, plus many more legal executives and unqualified staff, it may seem really difficult to find out who is a real expert.
But actually it’s quite simple.
Just look for membership of the accident and medical negligence panels run by the Law Society (the organisation representing solicitors nationwide) who have done the work for you. Only those few solicitors who can show real ongoing experience and knowledge about these kind of compensation claims make it onto the panels.
You can trust us at Bonallack and Bishop to be genuine experts in compensation claims – with a long standing member of the Law Society Personal Injury Panel heading our personal injury and medical negligence team.

- Whether After the Event (ATE) insurance is recommended
- What deductions (if any) might be made from compensation
- Your position if the claim does not succeed
We believe transparency on funding builds trust and avoids unpleasant surprises later.
FAQs
What is a 100% compensation, no win, no fee?
Receiving 100% of your compensation is different to a standard no win, no fee arrangement. Firms offering this type of arrangement recover their costs from the other side when you win and do not charge a success fee. While they may sound attractive, 100% compensation, no win, no fee arrangements have several distinct drawbacks. For instance, since these firms have no vested interest in securing the highest possible amount of compensation for you, they may be tempted to settle the claim for less than it’s worth.
What happens if you lose a no win no fee claim?
If you lose your no win no fee claim, you do not have to pay your solicitor’s costs. You may have to pay the other side’s legal costs, but your solicitor may have advised you to take out an insurance policy to protect you against this eventuality.
